Terms and conditions
Regulations of WrocApartments – Apartemanty Wrocław. Please read and comply with these Regulations, which are intended to ensure a comfortable and safe stay.
§ 1. INTRODUCTION
- These regulations specify the terms and conditions of reservation and rules for using of the flats in WrocApartments CityCenter and WrocApartments StarCenter, which are trademarks of WrocApartments sp. z o.o., NIP: 899-282-85-21.
- We would appreciate your compliance with these terms and conditions, which are intended to ensure a peaceful and secure stay for all our guests.
- Regardless of the method and channel of booking, these Regulations are an integral part of the contract, which is concluded by making a booking, paying an advance payment or the entire amount due for the stay in the apartment.
- By performing the above-mentioned activities, the Guest confirms that he has read and accepts the terms of the Regulations.
§ 2. RESERVATION
- The Guest may make a reservation of the flat in the following way:
a) through the booking system on www.wrocapartments.pl
b) through separate Internet booking systems. - In the case of reservations made through separate Internet booking systems (e.g. Booking.com), the reservation and its cancellation shall take place on the principles provided for in the regulations in force in those booking systems.
- A reservation may be made by a person of full legal age.
- The Guest is obliged to comply with the aforementioned rules of these Regulations at the time of commencing their stay in WrocApartments.
§ 3. CANCELLATION OF A RESERVATION AND SHORTENING OF STAY
- Up to 7 days before arrival, the Guest has the right to cancel the reservation without any costs. However, this right does not apply to a Guest making a non-refundable reservation or a promotional reservation.
- The intermediary is not obliged to refund any money for the period of stay that was not used by the Guest.
§ 4. APARTMENT RENTAL SERVICE
- The agreement concluded between the Landlord and the Guest covers the rental of the flat for residential purposes.
- The rental price includes all taxes and additional charges i.e. charges for utilities such as gas, electricity, water, internet and cleaning before the Guest’s arrival.
- In case of stays shorter than 7 days, additional cleaning and change of bed linen and towels during the guest’s stay is possible for an additional fee of 70 PLN.
- For stays longer than 7 days the flat is cleaned once a week without any additional charge referred to in § 4 point 3, which includes replacement of sets of sheets and towels.
- A parking space in the basement of the building may be available for the flat (maximum vehicle height 1.9 m.). The Landlord shall not be liable for damage to or loss of a car or other vehicle belonging to a Guest.
§ 5. GUEST’S OBLIGATIONS
- The Guest undertakes to use the subject of the lease solely for residential purposes and may not sublet it or offer it for free use to third parties.
- The Suite may not be used by a larger number of persons than specified in the description of the Suite to which the booking pertains and agreed with the Lessor. In the event of a greater number of persons arriving with the Guest in the flat than the number agreed upon with the Lessor, the Lessor may, at his/her sole discretion, demand additional payment, refuse to provide the service and access to the flat, or terminate the agreement with immediate effect without the necessity of reimbursement for the remaining period of lease.
- The Guest is obliged to respect the principles of good neighbourhood, generally applicable and local law. In the event that the Guest significantly violates the peace or welfare of the neighbours and does not respect the commonly applied norms of co-existence between people, the Lessor reserves the right to terminate the agreement with immediate effect and is not obliged to return the Guest’s money for the unused period of stay.
- The Guest is obliged to keep the flat in the same condition as at the beginning of their stay. It is forbidden to move furniture or household appliances/RTVs which are included in the flat.
- From 10.00 p.m. to 6.00 a.m., the building maintains strict curfew. In case of violation of the quiet hours by the Guest, the Guest shall be obliged to cover the costs of possible intervention of the called services.
- The Guest shall be responsible for any damage caused in the flat and its equipment during the time between the reception of keys and their return to the Lessor, as well as for damage caused by the Guest and persons accompanying them in the common area of the building in which the flat is located. The Guest shall be obliged to cover any damage no later than on the day of departure.
- In the event of damage, the Guest shall notify the Lessor immediately after it has been noticed.
- The Guest shall immediately report any damage or destruction which he/she finds upon entering the flat to the Lessor. Failure to report it may result in the Guest being charged with the repair costs.
- The Lessor reserves the right to charge a refundable deposit in the amount of PLN 1000 towards possible damage by pre-authorising the credit card and charging the Guest’s credit card in the event of damage in the flat.
- The Landlord has the right to charge the Guest for any damage caused during their stay which was not reported by the Guest and discovered after their check-out.
- The Lessor reserves the right to report any damage to the apartment, its equipment and common parts of the building caused by the Guest and accompanying persons to the portal through which the reservation was made.
- The Guest shall be responsible for the keys to the flat, the entrance chip and the remote control to the garage (if any) and in the event of losing them shall be obliged to cover the costs in the amount of PLN 500.
- The Guest is obliged to pay special attention to proper operation of water valves and electrical appliances. For the sake of fire protection the Guest is not allowed to use any electric powered devices which are not part of the apartment equipment except for: computers, shavers, phone/tablet chargers.
- For the sake of safety and comfort of the guests, as well as due to the fire protection system installed in the building, smoking cigarettes, tobacco, other substances and using candles in the flat and the balcony belonging to it is forbidden. In case of violation of the smoking ban the Guest is obliged to pay a fine in the amount of 500 PLN. Irrespective of the fine referred to in the previous sentence, the Guest shall be charged with costs connected with activation of the fire alarm system installed in the building and costs of intervention of relevant services, including building security and the internal technical department. In the event of persistent violation of the ban on smoking in the building, the Landlord shall have the right to terminate the agreement with immediate effect without the necessity of reimbursement for the remaining rental period.
- Pets are not allowed in the flat. If an animal is found to be present in the flat, the landlord may terminate the agreement with immediate effect without having to refund the money for the remaining rental period and charge the guest the sum of 300 PLN for cleaning.
- The Landlord has the right to refuse to accept a Guest who, during the previous stay, violated the rules, caused damage to the property of the Landlord or disrupted the principles of good neighbourly coexistence.
- The Lessor reserves the right not to provide access to the flat to Guests who are under the influence of alcohol or drugs or who behave aggressively and thus pose a direct threat to other people and property.
- The Guest does not have the right to publish, without the Lessor’s written consent, any photographs and multimedia materials that enable identification of the flat, in particular materials of an indecent, advertising or commercial nature. This prohibition also applies to making such materials available to third parties for publication.
- Organizing any kind of parties, hen and stag parties etc. in the flat is not allowed. In case of breaking the ban on organising parties the Guest shall be obliged to pay a fine in the amount of PLN 1,000.
- The Proprietor has the right to enter the flat rented by the Guest only in case of a threat to the safety of the Guest, the Guest’s non-compliance with the flat regulations, media failure in the flat or the Guest’s failure to vacate the flat on the day of departure by 11:00 am.
- In the event of failure to vacate the flat by 11:00 a.m., the Lessor shall be entitled to enter the flat in the absence of the Guest and move his/her belongings to another location, or charge the Guest with the cost of the next day.
- The Lessor shall not be liable to the Guest for loss of or damage to money, securities, valuables or items of scientific or artistic value resulting from causes beyond the Lessor’s control (e.g. water damage, fire, theft etc.).
- The Lessor shall not be liable for loss of or damage to items brought into the flat by the Guest.
- The Lessor shall not be responsible for items brought in and left after the end of the Rental.
- The Guest is obliged to provide true data when booking. In the event of a discrepancy between the data given during reservation and the data of the Guest at check-in, the Lessor shall have the right to terminate the agreement with immediate effect without the need to refund the money for the remaining period of the lease.
§ 6. ARRIVAL, COLLECTION OF KEYS AND PAYMENT
- A hotel day starts at 3 p.m. on the day of arrival (the first day of the reserved stay) and ends at 11 a.m. on the day of departure (the last day of the reserved stay).
- Leaving the flat on the day of departure takes place at the moment of handing over the keys to the Lessor by placing them in the reception area or by handing them over to the Lessor in person. The flat must be locked before leaving it.
- The first commenced hour after exceeding the hotel day as a result of not returning the keys until 11.00 a.m. on the day of departure is connected with the need for the Guest to pay an additional fee in the amount of PLN 50 payable on the day of departure, and after exceeding another hour the Lessor may charge the Lessee with the cost of the next day.
- Check-in takes place from 3 p.m. to 10 p.m. There is a late check-in option. In such a case, prior contact is required to confirm such an option.
- The check-in procedure requires the Guest to present a photo ID and a second document, which also confirms the identity of the Guest.
- The fee for the stay is paid in advance.
- The condition of issuing the keys is recording the payment on the Lessor’s bank account. The Lessor does not provide for payment in cash on site.
§ 7. THE LESSOR’S LIABILITY
- The Lessor undertakes to remove all defects occurring in the Apartment without undue delay, unless the nature of the defect determines a longer time for its repair. Breakdowns resulting from reasons beyond the Lessor’s control, such as media or Internet supply, do not constitute grounds for the resignation from the reservation or change of the reservation price. In the event of the occurrence of circumstances that were impossible to foresee and whose consequences cannot be immediately eliminated, the Lessor reserves the right to offer the Lessee a substitute flat, if available.
- The Landlord shall not be liable for any inconvenience caused during the stay due to noise coming from other flats, common parts of the building or public places.
- The Landlord shall not be liable for interruptions in the supply of utilities (electricity, water, Internet and TV) for reasons beyond the control of the Landlord.
- The Proprietor shall not be liable for claims in the event of accidents, injuries or death of the Guest or third parties in the Suite during the Guest’s stay.
§ 8 FORCE MAJEURE
- In the event of unforeseeable circumstances, the consequences of which cannot be immediately eliminated by usual means, the Landlord reserves the right to offer the Tenant alternative premises. The Landlord shall have the right to withdraw from the contract in the event of force majeure events. This also applies to cases in which the personal safety of the Tenant or their property, for reasons beyond the control of the Landlord, cannot be guaranteed.
- In the circumstances indicated in § 8 point 1 the amounts paid by the Lessee shall be immediately refundable, with the deduction of amounts due to the Lessor for services already rendered.
§ 9. COMPLAINTS
- In the event of any irregularities, the Guest has the right to lodge a complaint. The guest undertakes to report the irregularity immediately upon noticing it, but no later than upon check-out. Irregularities and claims regarding the offer by WrocApartments sp. z o.o. services notified after check-out will not be accepted. Complaints, complaints and all grievances should be sent to the address biuro@wrocapartments.pl
- A complaint shall be considered within 14 working days of its receipt. The Lessee shall be immediately notified by e-mail about the manner of its consideration.
§ 10. FINAL STATEMENTS
- The law applicable to disputes between the Lessor and the Guest shall be the Polish law. Disputes will be resolved by a court with jurisdiction over the Lessor.
- The Regulations shall enter into force on 01.10.2017 and shall remain in force until amended or repealed, which the Lessor may do at any time subject to the announcement of such amendments.
